In Muslim law, there is no concept of maintenance of child. In Islam, the parents are the caretakers of their children and they are obliged to provide for the physical, educational, and spiritual needs of their children. Child maintenance is a social concept and not a religious one. Maintenance provisions in Pakistan family laws mean that a father is responsible to maintain his children. Even if the father and mother are separated, the father still remains responsible for the maintenance of the children.
Islamic Law:
In Islamic law, the father/ Husband is the only one who is responsible for the maintenance of wife & child. The father must provide food, clothing and other needs to the child. If the mother is a Muslim, then the father only has to pay for the child.
