Let Know Family Courts Act 1964  For Khula Case

Under Family Law in Pakistan, Khula is the legal right of a Muslim woman to seek dissolution of her marriage if living with her husband becomes difficult or impossible. Khula is governed by Islamic principles and enforced through the Family Courts Act 1964 and the Muslim Family Laws Ordinance 1961.

A woman can file a Khula case in the Family Court without the husband’s consent. The court first attempts reconciliation between the spouses. If reconciliation fails and the wife is unwilling to continue the marriage, the court may grant Khula. In most cases, the wife is required to return her Haq Mehr or any benefit received from the husband as compensation.

Once the Family Court issues a Khula decree, the marriage is legally dissolved. The decision is binding, and the husband cannot stop the process if the legal requirements are fulfilled. Khula under Pakistani family law provides a lawful and respectful way for women to end an unhappy marriage while ensuring justice and protection of rights for both parties.
